No, the President does not legislate - that is left to the congress.   The executive branch cannot write laws.  The congress writes laws, passes them thru both chambers, then they go to the President and once he signs it becomes law. 

He can veto something he disagrees with, but then the congress can override that if they have enough support for the new law.

The executive branch works with what congress passed and was signed into law - and in this case the 1996 act clearly needs to be updated.   Meanwhile the executive has to interpret what congress passed, as you see here:

He is the FCC director - it is his task to write rules based on the laws the congress has passed - if clarification or major change is needed then congress can do that.   It appears that is in the works, it is under review and I expect changes and updating to the 1996 law in the next congress.
